Descripta is an artificial intelligence-powered platform that generates product descriptions from images and text inputs. The Service enables users to create, manage, and organize product listings with AI-generated content across three subscription tiers: Free, Pro, and Premium.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. Intellectual Property Rights

5.1 AI-Generated Content Ownership

Free & Pro Tier Users

You retain ownership of your uploaded content. By using the Service to generate AI descriptions, you grant Descripta a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display the AI-generated descriptions for marketing, demonstrations, and service improvement.

You retain the right to use the AI-generated descriptions for your own commercial purposes.

Premium Tier Users

You retain full, exclusive ownership of all AI-generated descriptions. Descripta does not retain any license or rights to use, display, or distribute your AI-generated content without your explicit written permission.

6. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited activities include:

  • Uploading content that infringes intellectual property rights of third parties
  • Generating descriptions for illegal, harmful, or deceptive products
  • Attempting to reverse engineer or extract the AI models
  • Using automated tools to scrape or harvest data
  • Interfering with or disrupting the Service

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Descripta does not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated descriptions will be accurate, complete, or suitable for your specific use case. You acknowledge that artificial intelligence technology has inherent limitations and that generated content may require human review.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESCRIPTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
